Призначення судово-медичних експертиз під час розслідування насильства щодо працівника правоохоронного органу: проблеми та шляхи їх вирішення
Анотація
Проаналізовано слідчо-судову та експертну практику щодо кримінальних проваджень, розпочатих у зв’язку з учиненням насильства щодо працівника правоохоронного органу. На підставі цього аналізу визначено можливості судово-медичних експертиз у кримінальних провадженнях зазначеної категорії, а також визначено типові помилки, яких допускаються слідчі під час їх призначення під час розслідування. Установлено, що типовими помилками є такі: призначення декількох експертиз для вирішення тих само питань, неправильне визначення виду експертизи, ненадання достатніх медичних даних, необхідних експерту для вирішення низки питань, зокрема матеріалів кримінальних проваджень, несвоєчасне призначення судових експертиз і некоректна постановка запитань експертові. Дано окремі рекомендації щодо усунення визначених типових помилок.
