Протидія корупції в умовах воєнного стану: аналіз проблем та можливостей
Анотація
Статтю присвячено аналізу проблем і можливостей протидії корупції в умовах воєнного стану. Початок повномасштабного вторгнення росії призвів не лише до суттєвих фінансових проблем в Україні, а й до зростання рівня корупції, що зумовило активні дії з боку держави щодо протидії їй. Розглянуто державні органи, що здійснюють регулювання корупційних проявів, а також проаналізовано нормативно-правову базу щодо протидії корупції в умовах воєнного стану в Україні з визначенням можливостей у цій сфері.
Відмічено, що найяскравішими проявами корупції є переказ коштів (незадекларованих) на інші рахунки (відмивання коштів через віртуальні рахунки), розкрадання гуманітарної допомоги, привласнення фінансових коштів, отриманих у вигляді допомоги під час конфлікту, несплата податків у зв’язку з воєнним станом тощо. Визначено, що причиною тіньової економіки варто вважати податкове навантаження, регуляторний тиск, монополізацію, недосконалу судову систему та безпосередньо корупцію.
Проаналізовано кроки державних органів та уведені ними програми щодо зниження рівня корупції. Розглянуто останні показники рівня корупції в Україні, зауважено, що показники рівня боротьби з корупцією в умовах воєнного стану значно зросли (проти минулого року), що стало можливим завдяки ефективній діяльності органів, створених для боротьби з корупцією, та інших державних установ.
Розглянуто кількісні показники гучних підозр та вироків за 2023 рік, при цьому враховано стягнення російського майна, яке було перераховано до спеціального фонду Державного бюджету України. Визначено, що проблемними залишаються аспекти публічних закупівель та доступу до відкритих даних про посадових осіб, підприємства тощо.
Запропоновано рекомендації, що мають на меті протидіяти корупції в країні, серед яких ключовими є: 1) інституційні рекомендації, що передбачають запровадження реформи Рахункової палати та Державної аудиторської служби України; 2) правові рекомендації, які окреслюють розроблення дієвих механізмів контролю з боку громадських організацій, ефективного використання активів корупціонерів та їхніх спільників на потреби держави; 3) структурні рекомендації, котрі передбачають утворення спеціалізованих відділів (та призначення відповідальних осіб) із метою запобігання корупційним проявам й іншим аналогічним ситуаціям та їх виявлення.
