Медіація у кримінальному провадженні: новели законодавства та перспективи його вдосконалення
Анотація
Висвітлено проблемні питання запровадження медіації у кримінальному провадженні в Україні, а також сформульовано пропозиції щодо їх вирішення. Вказано, що тривалий шлях України до унормування медіації увінчався успіхом 16 листопада 2021 р. ухваленням Закону України «Про медіацію» № 1875-ІХ. Натомість, запроваджуючи можливість проведення медіації у кримінальних провадженнях, законодавець взагалі оминув увагою питання про внесення змін до КПК України, зокрема щодо визначення статусу медіатора, встановлення меж медіації кримінально-правових конфліктів, формулювання особливостей порядку її проведення під час кримінального провадження. Окреслено шляхи вдосконалення кримінального процесуального законодавства щодо унормування медіації, особливу увагу приділено визначенню статусу медіатора як учасника кримінального провадження.
