Генеза складу правових відносин
Анотація
Статтю присвячено дослідженню особливостей ґенези складу правових відносин. Наголошено, що теорія правових відносин, яка виступає у вигляді широкого та різноманітного масиву знань і уявлень, звичайно може бути прийнята як основне джерело, що живить сам процес подальшого розвитку й удосконалення їх сутності, визначення та складу. Процесуальні повноваження в «чистому» вигляді не можна віднести ні до процесуальних прав, ні до процесуальних обов’язків. За своїм призначенням це в певному сенсі продукт синтезу прав і обов’язків. Насамперед – це компонент компетенції відповідного державного органу або посадової особи. Вони, володіючи процесуальними повноваженнями, не лише процесуально управомочені, але й зобов’язані виконувати передбачені процесуальним законом дії.
