Правоохоронна діяльність Національної гвардії в умовах воєнного стану
Анотація
Національна гвардія була створена ще на початку незалежності України, однак почала свій розвиток лише після 2014 року. Її функціонування зумовлено загрозою публічній безпеці й порядку держави, зокрема з боку російської федерації. Національна гвардія України є військовим формуванням, яке виконує правоохоронні функції та демонструє свій потенціал в умовах воєнного стану. У зв’язку зі специфічністю структури згаданого формування досліджено поняття «правоохоронна функція» та «правоохоронна діяльність». Правоохоронна діяльність під час воєнного стану полягає у здійсненні дій спеціально уповноваженими органами, які спрямовані на захист прав, свобод та інтересів громадян, інтересів держави та відповідають зазначеній у законі формі, враховуючи дію воєнного стану.
Зазначено, що Національна гвардія України має низку особливостей, серед яких адаптивність, здійснення превентивної діяльності та нерозривний зв’язок зі сферою зв’язку та комунікацій. Правоохоронна діяльність Національної гвардії України є багатовекторною, що підкреслює унікальну роль цього органу як гібридної структури, яка ефективно поєднує військові та правоохоронні функції в умовах комплексних загроз національній безпеці.
На основі виокремлених особливостей сформульовано напрями вдосконалення діяльності Національної гвардії України як суб’єкта правоохоронної діяльності. По-перше, інтегрування успішного закордонного досвід у вітчизняну структуру організації Національної гвардії України, адже у багатьох розвинених країнах існують військові формування, які реалізують схожі функції, проте мають більший досвід та інший набір повноважень. По-друге, розвиток інформаційного простору та прозорості, оскільки саме завдяки цьому можливо збудувати довірчі відносини між Національною гвардією України та населенням. По-третє, приділення особливої уваги цифровізації та диджиталізації діяльності Національної гвардії України як суб’єкта правоохоронної діяльності, що також слід пов’язати з підвищенням компетентності військовослужбовців та працівників Національної гвардії України з питань побудови інклюзивного безпекового середовища.
