Правовое регулирование хозяйственной деятельности аптек в Украине
Аннотация
Рассмотрены особенности правового регулирования хозяйственной деятельности аптек в Украине. Проанализировано законодательство, регулирующее обращение лекарственных средств. Изучены научные труды, посвященные правовому регулированию фармацевтической деятельности. Охарактеризована хозяйственная деятельность аптек. Указано, что розничная торговля лекарственными средствами должна происходить на основании лицензии в случае соблюдения аптекой лицензионных условий такой деятельности. Отмечено, что работники аптеки должны соблюдать требования законодательства о защите прав потребителей. Доказано, что предметом торговли является особая продукция – лекарственные средства, зарегистрированные в Украине. Предложены изменения в Закон Украины “О лекарственных средствах”. Подчеркнута необходимость правового урегулирования статуса аптек и особенностей розничной торговли лекарственными средствами.
