Медиация в уголовном производстве: новеллы законодательства и перспективы его совершенствования
Аннотация
Освещены проблемные вопросы проведения медиации в уголовном производстве в Украине, а также сформулированы предложения по их решению. Указано, что длительный путь Украины к нормированию медиации увенчался успехом 16 ноября 2021 принятием Закона Украины «О медиации» № 1875-ІХ. В то же время вводя возможность проведения медиации в уголовных производствах, законодатель вообще обошел вниманием вопрос о внесении изменений в УПК Украины, в частности по определению статуса медиатора, установлению границ медиации уголовно-правовых конфликтов, формулированию особенностей порядка ее проведения в ходе уголовного производства. Обозначены пути усовершенствования уголовного процессуального законодательства относительно определения порядка медиации, особое внимание уделено определению статуса медиатора как участника уголовного производства.
