Участь захисника у спеціальному досудовому розслідуванні кримінальних правопорушень
Анотація
Статтю присвячено комплексному аналізу питань, що стосуються особливостей участі захисника у спеціальному досудовому розслідуванні кримінальних правопорушень. На підставі аналізу КПК України 2012 р. окреслено особливості участі захисника у спеціальному досудовому розслідуванні, що дало змогу виокремити такі законодавчі неузгодженості: суперечливість положень закону щодо початкового моменту залучення захисника, недосконалість процесуального механізму залучення захисника, невизначеність строків направлення слідчим суддею ухвали про залучення захисника до регіональних центрів вторинної правової допомоги, можливості заміни адвоката тощо. За результатами дослідження надано пропозиції з усунення окреслених проблемних питань.
